Terms and conditions of participation and data protection: FLEXVIT Instagram giveaway
1. General
The organizer of the competition and the data controller is Flexible Sports GmbH (hereinafter referred to as “FLEXVIT”), Am Eichwasen 18, 72401 Haigerloch.
This giveaway is in no way affiliated with, sponsored by, endorsed by, or administered by Facebook, Instagram, or any other social media platform. By participating in the giveaway, the participant accepts these terms and conditions.
2. Action period
Participation in the competition is only possible online during the promotional period. This period is specified in the respective competition post and applies only to that specific competition. All entries received after this period will not be considered.
3. Eligibility
Participation is free of charge, except for any internet connection costs, and is independent of the purchase of goods or the use of a service. Eligible participants are individuals who are at least 18 years old, reside in Europe, and have their own profile on the respective social media platform. Employees and relatives of FLEXVIT are not eligible to participate in the competition and are excluded from participation. Entries from competition agencies and other automatically generated mass entries and submissions are expressly prohibited and will not be considered in determining the winners.
4. Terms of Use
Participation in the competition is as described in the respective competition post. Participation is only possible via the method described in the post – other methods of participation are excluded.
The winners will be drawn from all users who meet the above-mentioned requirements.
Multiple participation using different or multiple accounts, as well as other manipulative measures, will lead to the immediate exclusion of the participant. The prizes listed in the post will be raffled among all participants.
Winners will be notified via direct message. This may be done by letter, link, or email. The organizer of the competition will make every effort to reach the winners and will attempt to do so using all available methods. Winners must contact FLEXVIT via private message within 24 hours of being notified and provide their name, address, telephone number, and email address so that shipping can be arranged. By doing so, participants agree that this information will be shared with the respective shipping provider to facilitate delivery.
Each participant is responsible for the accuracy of the data they submit to FLEXVIT. If the winner does not contact FLEXVIT within 24 hours of being notified , another participant will be drawn.
Prizes cannot be redeemed for cash and are non-transferable. Participation in this competition does not obligate you to make a purchase from FLEXVIT. Purchases from FLEXVIT have no influence on your chances of winning.
Legal recourse is excluded.
5. Data Protection Regulations
The personal data collected from the winners will be used by FLEXVIT solely for the purpose of conducting the prize draw. No other processing or use of the personal data will take place . No personal data will be shared with third parties.
The winner can request information about the data stored about him at any time and/or object to the storage and/or use of his data with effect for the future and request the deletion or blocking of his personal data at FLEXVIT.
6. Premature termination of the competition
FLEXVIT reserves the right to terminate the competition at any time without prior notice. FLEXVIT will make use of this right in particular if, for technical reasons (e.g., viruses in computer systems, manipulation or errors in hardware/software) or for legal reasons, the proper conduct of the competition cannot be guaranteed.
7. Liability
FLEXVIT shall not be liable in particular for damages that may arise from errors, delays or interruptions in transmission, malfunctions of technical equipment and services, incorrect content, loss or deletion of data, viruses or in any other way during participation in prize draws, unless such damages are caused intentionally or through gross negligence by FLEXVIT (its officers, employees or agents).
8. Grant of rights
The participant agrees that, in the event of winning, their Instagram account may be mentioned and published on FLEXVIT's Instagram channel in a post and/or story.
9. Participant's insurance
The participant warrants that they own all rights to the content they publish and that they are not using someone else's name as their Instagram account name. They indemnify FLEXVIT against any such claims by third parties.
10. Other
The laws of the Federal Republic of Germany apply. Should any of these provisions be or become invalid, the validity of the remaining terms and conditions of participation shall remain unaffected. FLEXVIT reserves the right to adapt the content and information contained on this fan page, as well as these terms and conditions of participation, to changes in the legal framework.
